2. General terms and conditions of use of the site and the services offered
By using the EFI Tirana site, the user fully and unconditionally accepts the general terms of conditions and use set out hereafter. These terms and conditions of use may be added to or modified at any time. Users of the EFI Tirana site are therefore advised to review them regularly.
Users usually enjoy uninterrupted access to the site. EFI Tirana has the right to suspend access to the site to carry out maintenance. In such event, the school will notify users in advance of the dates and times of the intervention.
The EFI Tirana site is regularly updated by EFI Tirana. The legal notice may also be modified at any time. The user is nevertheless responsible for referring to this notice as much as possible to take note of such changes.
3. Description of the services provided
The EFI Tirana site aims to provide information regarding all the school’s activities.
EFI Tirana endeavours to provide information that is as accurate as possible on the EFI Tirana site. However, it may be held liable for omissions, inaccuracies or inadequacies in its updates, whether through its own fault or that of its third-party partners who provide this information.
All the information on the EFI Tirana site is provided for information purposes only and is subject to change. Furthermore, the information provided on the EFI Tirana site is not exhaustive. It is information that has been subject to change since its publication online.
4. Contractual limitations on technical data
The site uses JavaScript technology.
Those responsible for the site may not be held liable for any form of material damage caused through use of the site. The site user also agrees to access the site on a recent, virus-free device via an updated, latest-generation web browser.
5. Intellectual property and counterfeiting
Any unauthorised use of the site or any of the elements contained therein will be considered an act of counterfeiting, and thus, subject to legal proceedings in accordance with the provisions of articles L.335-2 et seq. of the French Intellectual Property Code.
6. Limitations on liability
EFI Tirana may not be held liable for any form of direct or indirect damaged caused by the user’s device while accessing the EFI Tirana site, whether resulting from the use of a device not corresponding to the criteria specified in Point 4, or the appearance of a bug or incompatibility.
Likewise, EFI Tirana may not be held liable for any form of indirect damage (such as loss of business or loss of opportunity) resulting from the use of the EFI Tirana site.
Interactive spaces (possibility to ask questions in the contact form) are available to users. EFI Tirana reserves the right to delete, without prior formal notice, any content published in this space which contravenes applicable legislation in France, particularly provisions relating to data protection. If required, EFI Tirana also reserves the right to hold the user civilly or criminally liable, especially if they post racist, abusive, libellous or pornographic content in any form (text, photos, etc.).
7. Personal data management
In France, personal data is protected by Law 78-87 of 6 January 1978, Law 2004-801 of 6 August 2004, and Article L. 226-13 of the French Penal Code, and the European Directive of 24 October 1995.
When a user accesses the EFI Tirana site, the following information may be collected: the URL of links through which the user has accessed the EFI Tirana site, the user’s Internet service provider, and the user’s Internet Protocol (IP) address.
In all cases, EFI Tirana only collects the personal data relating to the user that it requires to carry out certain services offered on the EFI Tirana site. The user provides this information fully aware of its intended use, particularly when it is entered manually by the user. EFI Tirana site users are therefore duly informed of whether they are required or not to provide this information.
In accordance with the provision of articles 38 et seq. of Law 78-17 of 6 January 1978 relating to data protection, every user reserves the right to access, modify and delete any personal data concerning them by sending a signed request in writing, accompanied by a copy of an ID document signed by the holder of such document, and by specifying the address to which the response must be sent.
No personal information belonging to, and provided by, the user on the EFI Tirana site is published without the user’s consent, exchanged, transferred, transmitted or sold via any medium to third parties. Only in the event of a takeover of EFI Tirana and its rights would such information be transferred to the potential buyer, which would then need to fulfil the same obligation of storing and modifying data relating to users of the EFI Tirana site.
The databases are protected by the provisions of the Law of 1 July 1998 implementing Directive 96/9 of 11 March 1996 on the legal protection of databases.
8. Hyperlinks and cookies
The EFI Tirana site contains many hyperlinks to other sites, the use of which on the site has been authorised by EFI Tirana. However, EFI Tirana cannot verify the contents of these sites, and thus, may not be held liable for any consequences relating to access to these sites.
Browsing through the EFI Tirana site may result in cookies being installed on the user’s computer. A cookie is a small file that does not allow the user to be identified, but that registers information relating to the browsing session on a site from a particular computer. The data obtained in this way facilitates future browsing on the site and helps determine site visit frequency.
Refusing to allow the installation of a cookie could prevent access to certain services. Users can configure their computer settings as follows to reject the installation of cookies:
On Internet Explorer: Settings icon > Internet options. Click on Privacy and select the Block cookies option(s). Click on OK.
On Netscape: Edit menu bar / Preferences. Click on Advanced and select Disable cookies. Click on OK.
9. Applicable law and jurisdiction
Any disputes relating to the use of the EFI Tirana site are governed by French law. Jurisdiction is attributed exclusively to the competent courts of Paris.
